Terms of Service

These terms govern your use of Ember, the email warmup and deliverability service operated by 1Labs AI Studio (One Infinity Labs, Inc.) ("we", "us"). By creating an account or connecting a mailbox, you agree to them.
1. The service
Ember builds sender reputation for mailboxes you own or are explicitly authorized to manage: it connects them over IMAP/SMTP, exchanges human-like warmup email between them on a ramp schedule, performs peer actions (opening, replying, marking important, rescuing from spam), and reports placement and health scores. You accept that placement figures and health scores are estimates derived from your warmup pool — they are not a guarantee that any particular email will reach any particular inbox, and we make no such guarantee anywhere. Ember is not a cold-email sender and includes no features for emailing third parties.
2. Accounts
- You must provide a working email address (verification is required) and keep your credentials secure. You are responsible for activity under your account.
- You may only connect mailboxes you own or are explicitly authorized to manage — the connect flow asks you to confirm this, and the confirmation is binding.
- You must be at least 16 and able to form a contract.
3. Subscriptions and billing
- Paid plans are billed by Polar, our merchant of record. Plan limits (mailbox counts) are listed in the pricing section and enforced in software.
- Every plan starts with a 14-day free trial that requires no card. Trials are limited to 2 mailboxes.
- If a renewal payment fails, you get a 3-day grace period before warmup pauses. Cancellation and refunds are described in the Refund Policy.
4. Acceptable use
The short version: warm your own mailboxes, don't use Ember to enable spam. The full rules are in the Acceptable Use Policy, which is part of these terms. Violations — especially connecting mailboxes you don't control or using warmup to support abusive sending — lead to suspension.
5. Your data and your providers
Your mailbox credentials and warmup data are handled as described in the Privacy Policy and DPA. Warmup email transits your own mail providers, and your relationship with those providers is yours: you are responsible for complying with their terms, and you accept that providers may throttle, flag, or restrict automated activity. Ember's conservative defaults are designed to stay well within ordinary use, but we cannot control provider behavior.
6. Our IP
The Ember software, warmup engine, template pool, and brand are ours or our licensors'. We grant you a non-exclusive, non-transferable license to use the service for mailboxes you are authorized to manage while your subscription or trial is active.
7. Disclaimers
The service is provided "as is". We disclaim implied warranties to the extent the law allows. In particular: deliverability depends on factors we do not control (your domain's history, your real sending behavior, DNS configuration, provider policy changes), warmup is a reputation aid rather than a remedy for bad sending practices, and placement metrics are estimates from your warmup pool.
8. Liability
To the extent permitted by law, our total liability for claims arising from the service is capped at the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages, for provider actions against your mailboxes or domains, or for the outcome of email campaigns you send outside Ember.
9. Suspension and termination
You can disconnect mailboxes or delete your account at any time — disconnection destroys the mailbox's credentials immediately. We may suspend or terminate accounts that violate these terms or the Acceptable Use Policy, with notice where practicable.
10. Changes and governing law
We may update these terms; material changes are announced by email at least 14 days before they take effect. These terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules.
